The present Terms and Conditions of Sale and Use are concluded between, on the one hand, MYSTIIC, and on the other hand, any person having made a purchase on the website http://mystiic.com (the "Website"), hereinafter referred to as the "Customer". On this Website, the terms "we", "us" and "our'' refer to MYSTIIC. Any purchase on the Website automatically entails the acceptance of the entirety of these conditions of which the Customer acknowledges having taken knowledge prior to his order.
The use of the Website includes accessing, browsing or registering. The Customer who buys on the Website declares that he/she is legally capable of committing himself/herself under the present general conditions of sale.
2 – PRICES
All prices are in Euros and VAT free (VAT exemption - article 293 B of the French General Tax Code) for France and the European Union, unless otherwise stated, and exclude processing and shipping costs. MYSTIIC reserves the right to modify its prices without prior notice and the prices applied to the Customer correspond to those displayed on the Website at the time of his order. The goods remain the full property of MYSTIIC until the total amount due is received, and paid by the Customer.
BREXIT : Since January 1st 2021, with the exit of the United Kingdom from the European Union, goods coming from the United Kingdom are no longer considered as intra-community deliveries and acquisitions, but as imports and exports. When exporting goods to the UK and following the new VAT collection regime for flows with a value of less than £135 (150€), the French e-merchant is obliged to collect Value Added Tax (VAT) at the time of purchase and to pay it back to the UK government afterwards. The normal rate (20%) of the English VAT will be applied at the time of the validation of the Customer's order.
EU : MYSTIIC is bound, in accordance with Council Directive (EU) 2018/1713 of 6 November 2018 amending Directive 2006/112/EC, to charge a reduced VAT on sales of digital content and services to Customers in the European Union. The VAT rate applied to such content and services will be calculated according to the location of the Customer. MYSTIIC makes all efforts to present and describe its products in the most precise and accurate way possible.
4 – PLACING A PRE-ORDER OR ORDER
The placing of a Pre-order or an Order is subject to the respect of the procedure set up by MYSTIIC, which includes successive steps leading to its validation (selection of items, viewing of the basket, choice of delivery terms, validation and confirmation of order, payment). The purchase/sale contract is valid and concluded between the Customer and MYSTIIC as soon as the Customer registers his pre-order or his order on the Website ("Date of conclusion of the purchase/sale contract").
MYSTIIC commits to honor received pre-orders and orders, only within the limits of available stocks.
MYSTIIC is likely to refuse an order if the product that the Customer wishes to purchase is no longer in stock, if MYSTIIC has identified an error concerning an item, if MYSTIIC is unable to obtain authorization for the Customer's payment or if the Customer already has a dispute with MYSTIIC.
Definition: special order made directly by the Customer on the Site, for products not available in stock and not yet manufactured. The pre-orders are firm and final after payment by the Customer of the totality of the price, and allow financing the project before its achievement.
Products subject to a pre-order are shipped and delivered to the Customer according to a delivery date which is specified on the Site for information purposes only, expressed in months, and estimated at approximately 5 to 6 months following the opening date of the pre-orders. Any delay in delivery (manufacturing, transport, etc.) will not result in the cancellation of the pre-order, unless the product is cancelled by the manufacturer or the supplier. In the event of cancellation, 10% of the price of each product is non-refundable.
The ordered products are shipped and delivered by MYSTIIC to the Customer within 10 days following the date of conclusion of the purchase/sale contract.
Products in digital format are delivered to the Customer via a download link sent by e-mail and containing a file in PDF format. This file does not contain any DRM ("digital right management") protection measures and is accessible on all media.
5 – DELIVERY
Orders are generally processed and shipped within 48 hours, unless otherwise specified in the product description. MYSTIIC does not ship on Saturdays, Sundays and public holidays. The orders are shipped according to the conditions of the DAP incoterm (Delivered at place). In the event of customs duties, import taxes or applicable local taxes, these charges are payable by the Customer and are the sole responsibility of the Customer.

6 – PAYMENT
Once the Customer validates his/her order, he/she accepts the entirety of the General Terms and Conditions of Sale and Use. The Customer pays on the Website by Paypal, Apple Pay or credit card (Visa, Mastercard or American Express) via the secure payment platform Stripe and/or by means of a voucher.
7 – SECURITY AND SAFETY
MYSTIIC entrusts the security of its transactions to the service provider Stripe. The payment is secured thanks to the online payment system of our partner Stripe. The banking data circulate on the Internet network only in encrypted form, i.e. they are coded in such a way as to make them totally unreadable and are thus never kept by MYSTIIC.
8 – YOUR INFORMATION
All the personal data communicated by the Customer on the Website are subject to computer processing for the processing and delivery of orders and the suggestion of products adapted to the Customer's needs. This data is exclusively reserved for MYSTIIC.
The Customer can subscribe to the MYSTIIC newsletter and thus choose to be regularly informed of the offers proposed. He has, at any time, the possibility to unsubscribe by clicking on the link provided for this purpose on each newsletter.
9 – RETURNS AND REFUNDS
The Customer has a period of 14 days counting from the day of receipt of his order to request a refund. The Customer must notify MYSTIIC of his decision to withdraw before the expiry of this period by means of an unambiguous statement by email: firstname.lastname@example.org.
This period is considered to have been respected if the Customer returns the product(s) before the expiry of the fourteen-day period and if the product(s) is (are) intact, unopened and in its (their) original packaging.
The Customer can use the model withdrawal form proposed below and must return the product(s) to the following address:

In case of withdrawal by the Customer, MYSTIIC will refund the amount of the order, including delivery costs (with the exception of additional costs resulting from the fact that the Customer has chosen, if applicable, a more expensive delivery method than the standard one proposed on our Website) no later than fourteen days from the day MYSTIIC is informed of the Customer's decision to withdraw.
MYSTIIC will proceed with the refund using the same payment method as the one used for the initial transaction. MYSTIIC can defer the refund until receipt of the returned products or until the Customer has provided a proof of shipment of the products, the date retained being the first of these events.
When the order is accompanied by a gift offered to the Customer under conditions – for example, a gift offered only if a minimum order amount is reached – and the Customer no longer meets the conditions necessary to obtain the gift due to the exercise of the right of withdrawal by the Customer, the gift must be returned to MYSTIIC with the returned product(s).
The Customer will have to pay the direct costs of returning the product(s). MYSTIIC advises the Customer to choose a shipping method with a tracking number. Without a tracking number, MYSTIIC will not accept any claim.
Purchases of digital content are considered firm and final and may not give rise to any exchange or refund once MYSTIIC has accepted and executed the Customer's order by making the download link immediately available by email.
10 – GIFT CARDS
The gift cards sent by MYSTIIC in exchange for a return or purchased by the Customer are usable for 6 months on all the products offered on the Website. The gift cards cannot be combined with each other or with promotional codes. No gift card will be exchanged or refunded, even partially, for any reason whatsoever (including theft, loss, deterioration or expiration).
11 – PROMO CODES
Promotional codes apply to non-rebate base prices only. Promotional codes cannot be combined with each other or with vouchers. Promotional codes can be used once per customer account unless otherwise specified by MYSTIIC. These codes are not refundable during an exchange.
12 – INTELLECTUAL PROPERTY
All the elements present on the Website, whether visual, textual or sound, are the exclusive property of MYSTIIC, or of the holder of the intellectual property rights involved, and are as such protected by the intellectual property code and copyright. As such, any reproduction of the MYSTIIC brand or of the Website, in part or in full, is strictly forbidden.
13 – LIMITATION OF LIABILITY
MYSTIIC company cannot be responsible to third parties for indirect damages, special damages or incidents resulting from negligence, failure or clumsiness on the part of the Customer, or resulting from misuse by the Customer of any of the products offered for sale on the Website. Concerning the access to the Website, the consultation of the latter, the process of order, payment, delivery and service, the MYSTIIC company has only an obligation of means. MYSTIIC cannot be held responsible for any inconvenience or damage inherent to the Internet network, notably any disruption of the connection or any intrusion of a computer virus. Moreover, MYSTIIC is exempt from any responsibility for any fact qualified as force majeure according to the jurisprudence of the Court of Cassation. Finally, the liability of MYSTIIC is limited to the amount of the Customer's order.

15 – LEGAL STUFF
The Customer accepts and fully acknowledges that French law governs the present General Terms and Conditions of Sale and Use, as well as any dispute or litigation that may arise between the Customer and the company MYSTIIC. Moreover, the Internet user (or the Customer) accepts that in case of dispute, following a visit or a purchase on the Website, the French courts are recognized as competent.

We reserve the right, at our sole discretion, to update, modify or replace any part of these Terms and Conditions of Sale and Use by posting updates and changes on our Website.
