INTRODUCTION
These General Terms and Conditions of Sale and Use (the “Terms”) are concluded between MYSTIIC and any person who makes a purchase on the website https://mystiic.com (the “Website”), hereinafter referred to as the “Customer.” On this Website, the terms “we,” “our,” and “us” refer to MYSTIIC. Any purchase made on the Website implies full acceptance of these Terms, which the Customer acknowledges having read prior to placing an order.
ARTICLE 1 – TERMS OF USE
The use of the Website includes accessing, browsing, or registering. The Customer who makes a purchase on the Website declares that they are legally capable of entering into agreements under these General Terms and Conditions of Sale and Use.
ARTICLE 2 – PRICING
All prices displayed on the Website are exclusive of taxes unless otherwise stated, and do not include processing and shipping fees. MYSTIIC benefits from VAT exemption under Article 293B of the French General Tax Code. Product prices are indicated in euros (EUR/€). MYSTIIC reserves the right to modify its prices without notice, and the prices applied to the Customer are those displayed on the Website at the time of order.
Goods remain the full property of MYSTIIC until full and effective payment of the price by the Customer.
ARTICLE 3 – PRODUCT DESCRIPTION
MYSTIIC strives to present and describe its products as accurately and precisely as possible.
ARTICLE 4 – PRE-ORDER AND ORDER
Placing a Pre-Order or Order is subject to the procedure established by MYSTIIC, which includes successive steps leading to its validation (selection of items and cart review, choice of delivery options, order confirmation, payment). The purchase/sale contract is valid and concluded between the Customer and MYSTIIC once the Customer registers their pre-order or order on the Website (hereinafter referred to as the “Purchase/Sale Contract Date”). In accordance with Article L.121-19-2 of the French Consumer Code, the Customer receives an email confirming and summarizing their pre-order or order after validation.
MYSTIIC is committed to fulfilling pre-orders and orders received only within the limits of available stock.
MYSTIIC reserves the right to refuse an order in the following cases: if the product the Customer wishes to purchase is out of stock, if an error concerning an item has been identified, if MYSTIIC is unable to obtain payment authorization from the Customer, or if the Customer is involved in an ongoing dispute with MYSTIIC.
4.1. Pre-Order
Definition: A pre-order is a special order placed directly by the Customer on the Website, for products that are not available in stock and have not yet been manufactured. Pre-orders are firm and final after full payment by the Customer, and they help fund the project before it is carried out.
Products subject to a pre-order are shipped and delivered to the Customer within the delivery timeframe indicated on the pre-order page of the Website. This timeframe may be extended in the event of force majeure as defined by French jurisprudence. Any delay in timelines (manufacturing, transport, etc.) will not result in the cancellation of the pre-order unless the product is canceled by the manufacturer or supplier. In the event of cancellation by MYSTIIC, the Customer will be fully refunded the amount paid for the pre-order.
4.2. Order
In accordance with Article L216-1 of the French Consumer Code, products ordered are shipped by MYSTIIC and delivered to the Customer without undue delay and at the latest within 30 days from the date of the purchase/sale contract, unless otherwise stated at the time of order. In the event of exceeding this period, the Customer will be informed as soon as possible and may cancel the order with a full refund.
ARTICLE 5 – INTERNATIONAL SHIPPING
Orders are generally processed and shipped within 72 hours, unless otherwise indicated in the product description. MYSTIIC does not ship orders on Saturdays, Sundays, or public holidays. Orders are shipped under the DAP (Delivered At Place) Incoterm.
In the event that customs duties, import taxes, or local taxes apply, these fees are the sole responsibility of the Customer. MYSTIIC cannot predict or control any additional charges that may be imposed by local authorities, and we recommend that the Customer check their country’s customs regulations before placing an order.
Delivery times may vary depending on the destination, local customs procedures, and other factors beyond MYSTIIC’s control. The delivery times indicated are generally observed, but they may be extended in the event of force majeure or customs delays. MYSTIIC cannot be held responsible for delivery delays due to customs issues or other unforeseen circumstances related to international shipping.
The Customer is responsible for providing a correct and complete delivery address. MYSTIIC cannot be held responsible for delays or delivery failures resulting from an incorrect or incomplete address provided by the Customer. Furthermore, MYSTIIC cannot be held responsible for the non-receipt of an order due to the Customer’s failure to comply with local customs requirements.

ARTICLE 6 – PAYMENT
Once the Customer validates their order, they accept without reservation all the General Terms and Conditions of Sale and Use. Payment is made on the Website via PayPal, Apple Pay, Google Pay, or by credit card (Visa, Mastercard, Discover, or American Express) through the secure payment platform Stripe.
The Customer’s order may be subject to 3D Secure verification. The 3D Secure system is an authentication payment method designed to ensure optimal security during online purchases. During payment, the Customer’s bank verifies the identity of the cardholder before validating the transaction.
ARTICLE 7 – PAYMENT SECURITY
MYSTIIC entrusts the security of its transactions to Stripe. Payment is secured through our partner Stripe’s online payment system. Banking data only circulates on the Internet in encrypted form, meaning they are encoded to make them completely unreadable, and they are never stored by MYSTIIC.
ARTICLE 8 – PRIVACY POLICY
All personal data provided by the Customer on the Website is subject to data processing intended for order management, delivery, and the suggestion of products tailored to the Customer’s needs. This data is exclusively reserved for MYSTIIC and is never shared with third parties without the Customer’s prior consent, except for the purposes of executing the order (e.g., delivery service providers).
In accordance with the French Data Protection Act n°78-17 of January 6, 1978, as amended, and the General Data Protection Regulation (GDPR) n°2016/679 of April 27, 2016, the Customer has the right to access, rectify, limit, port, and delete their data. ARTICLE 9 – RETURN POLICY
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of 14 days from the date of receipt of their order to exercise their right of withdrawal without having to provide a reason.
To exercise this right of withdrawal, the Customer must notify MYSTIIC of their decision to withdraw before the 14-day period expires by sending an email to the following address: hello@mystiic.com. This notification must be clear and unambiguous. The Customer may, if they wish, use the following withdrawal form template in their email:
“I hereby notify you of my withdrawal from the contract relating to the sale of the following product(s):

Upon receipt of the withdrawal request, MYSTIIC will send the Customer a return confirmation email, including all the necessary information to proceed with the shipment of the returned product(s).
This period is deemed respected if the Customer returns the product(s) before the expiration of the 14-day period, ensuring that they are intact, unopened, and in their original packaging. The Customer must bear the direct costs of returning the product(s). MYSTIIC recommends opting for a shipping method with tracking, as without this tracking, no claims can be accepted.
In the event of withdrawal, MYSTIIC will refund the order amount, including the initial delivery costs corresponding to the standard or most economical delivery option, excluding additional costs related to a more expensive delivery method chosen by the Customer, no later than 14 days from the day MYSTIIC is informed of the decision to withdraw. The refund will be made using the same payment method used for the initial transaction. MYSTIIC may withhold the refund until it has received the returned products or until the Customer has provided proof of shipment, whichever is earlier.
In the case of a partial return of the order, MYSTIIC will only refund the returned items. The initial shipping costs will not be refunded as they cover the cost of shipping the entire order.
When the order is accompanied by a gift offered under certain conditions (e.g., a gift offered only if a minimum order amount is reached), and the Customer no longer meets the conditions necessary to receive the gift due to the exercise of the right of withdrawal, the gift must be returned to MYSTIIC along with the returned product(s).
ARTICLE 10 – PROMOTIONAL CODES
Promotional codes are not cumulative and are valid for one use per Customer account unless otherwise instructed by MYSTIIC. They apply only to non-discounted base prices and are not refundable in case of an exchange.
ARTICLE 11 – INTELLECTUAL PROPERTY
All elements on the Website, whether visual, textual, or audio, are the exclusive property of MYSTIIC or the intellectual property rights holder concerned, and are therefore protected by the Intellectual Property Code and copyright. As such, any reproduction of the MYSTIIC brand or the Website, whether partial or complete, is strictly prohibited.
ARTICLE 12 – LIMITATION OF LIABILITY
MYSTIIC shall not be liable to third parties for indirect damages, special damages, or incidents arising from the Customer’s negligence, failure, or mishandling, or resulting from the Customer’s improper use of any of the products offered for sale on the Website. Regarding access to the Website, browsing it, the ordering process, payment, delivery, and service, MYSTIIC only has an obligation of means. MYSTIIC’s liability cannot be engaged for any inconvenience or damage inherent to the Internet, including any disruption of connection or any intrusion of a computer virus. Furthermore, MYSTIIC is exempt from any liability for any event qualified as force majeure under French jurisprudence. Finally, MYSTIIC’s liability is limited to the amount of the Customer’s order.
ARTICLE 13 – WARRANTY
Products sold on the Website are covered by the legal warranty of conformity in accordance with Articles L.217-4 and following of the French Consumer Code, as well as the warranty against hidden defects in accordance with Articles 1641 and following of the French Civil Code.

ARTICLE 15 – GOVERNING LAW
The Customer fully accepts and acknowledges that these General Terms and Conditions of Sale and Use, as well as any dispute or conflict that may arise between the Customer and MYSTIIC, are governed by the laws of France. Furthermore, the Customer agrees that, in the event of a dispute following a visit to or purchase from the Website, the courts of France shall have exclusive jurisdiction.
However, the Customer should be aware that, depending on their country of residence, local laws may provide additional protections that supersede this agreement, particularly in the case of consumer rights. While MYSTIIC specifies French law and jurisdiction, local courts may ultimately determine that certain disputes should be resolved under the laws and within the courts of the Customer’s own country. Therefore, enforcing this clause in international contexts, especially in countries like the United States, may be subject to legal challenges.
